We like things simple. Based on our business model and commercial terms, we have drafted our terms to make them fair and balanced for you and us. And to make them as readable as possible without years of law school.
1. DEFINITIONS
Defined terms shall have the same meaning in these Comapy Terms and vice-versa.
“Renderby Services” means the services described in Clause 2 (Scope of Renderby Services).
“Artist” means a third-party independent talent (who may be an individual or a company) who is registered on our Platform and may perform the rendering Services.
“Creative Director” means, Renderby’s core team member who is responsible for getting your services done from start to finish.
“Due Date” means the date on which all Renderby Services are due to be completed for a Project.
“Project” means a render creation project as described under the ‘Project Brief’ provided by you.
“Project Brief” means all agreed requirements, budget, background, creative approach, messaging, references, timelines, deliverables, service levels, and other details for a Project.
“Project Cost” means the cost we spend on the Project.
“Renderby Service Fee” means the fees paid by you to us for getting you the services from the artists.
“Project Value” means the full cost of a Project, which is the sum of the Project cost and Renderby service fee.
2. SCOPE OF RENDERBY SERVICE
2.1 Projects.
Our “Creative director(s)” shall understand your project needs and onboard artist(s) to finish them with the highest quality within the timeline. A team of art directors and projects head will oversee the process to achieve greater results.
All design details need to be furnished by you whenever required. Missing details, if any, are duly highlighted by the creative director along with the artist.
The entire project is managed and controlled in a project management platform, where all parties involved can see and comment on progress in real-time.
2.2 Iterations
The price includes up to two iterations which involve minor changes in the areas of material/design/furniture. In special cases, we are flexible to go up to four iterations which will be discussed during the project commencement.
In the scenario where the number of iterations exceeds or deviates from the design brief intent, the creative director shall negotiate on behalf of the artist with you to determine the extra charges for making the revisions/changes.
2.3 Timeline
The project timeline shall be mutually agreed upon after a review of all the input details received once the project is fully scoped.
If there are any delays in unforeseen situations, we are obliged to inform you duly.
2.4 Payments
You shall deposit 50% of the project cost and the Renderby service fee in full as an advance payment for commencing the artist onboarding.
The balance 50% payment needs to be transferred to Renderby upon approving the rough renders.
2.5 Refunds Policy.
we do have a money-back policy which guarantees that if any artist you hire doesn’t deliver to what was mutually agreed upon in the scope of work of the project, you will receive either a partial or full refund, depending on the amount of work that has been done. The amount of the refund is agreed upon either between you and the artist or by our team through a dispute resolution process in case you can’t come to an agreement with the artist.
Regardless of whether a partial or full refund is due, Renderby fees are always non-refundable.
3. YOUR RESPONSIBILITIES
3.1 Your instructions.
You shall provide us with full, timely instructions and all relevant details to work on your renders. We are not responsible for any delays in the Renderby Services or the completion of the Project which arose due to your failure to comply with this clause.
3.2 Your Project.
If you choose to delay the Project or change the due date of the Project, we request that you inform us duly.
3.3 Artists
You shall not contact our Artists to perform services for you outside of the Projects. Where we provide communication functions with the Artists, Renderby project management workspace, you are required to use only such functions to communicate with the Creators.
